Privacy Policy

The subsequent privacy policy summarizes the service, features, and privacy conduct of the “Cash Advance App: Payday Loans” mobile application (the “App”)

Disclosure

The proprietor of The App is not a credit broker or a lender and has no decision-making power when it comes to issuing financial products, loan approval, or the terms of any loan.

Its role is as a tool to connect lenders and prospective borrowers only.

The App provides a form to capture user data, which is encrypted and sent to a group of Lender Partners.

It is these third parties that establish any loan offer, its interest rate (APR), others, fees, and the terms and conditions of the loan agreement.

The Information The App Collects

Amid using The App, some information that could identify an individual is collected, i.e., personally identifiable information (PII).

Non-personally identifiable information (Non-PII) that can’t be directly linked to an individual is also collected.

PII is captured when a prospective borrower completes the loan request form in The App when trying to connect with a Lender Partner, or when contacting support via The App.

This might include the user’s real name, home address, date of birth, email, cell or home phone number, Social

Security Number (SSN), citizenship, type of employment, income and wage frequency, driver’s license, homeowner or rental status, and bank account information.

Web analytics tools and “cookies” may be used to collect non-personally identifiable information from a user’s device.

This includes but is not limited to the link used to refer to The App, the user’s IP address, device and browser, language, and their in-app browsing behavior, i.e., what sections or pages they navigated through.

The App uses this data from users as a whole to improve The App or web experience.

(Cookies are small files downloaded in the background to a user’s device or browser that The App can recognize whenever it’s accessed.

This holds Non-PII and can be blocked by the user).

Non-PII might also be shared with Lender Partners for the sake of statistics and user trends without tying any single piece of information to a single user’s identity.

Advertising partners that serve in-App ads and Lender Partners that advertise directly in The App might also utilize cookies to collect Non-PII, but this information does not crossover with PII and no individual is identifiable when served advertisements by third parties.

How The App Uses Personally Identifiable Information

As summarized above, PII is collected for the sole aim of delivering the loan connection service the app users desire.

The info is passed on to each Lender Partner as part of the connection process.

If a loan agreement is made with a Lender Partner, the lender might use the info in the process of enforcing the agreement, settling disputes, and fixing technical issues.

It is agreed that the use of this info will not go beyond what is deemed appropriate to deliver the loan service properly and efficiently.

By voluntarily installing The App and sharing their PII via the loan request form, users consent to it being sent to the aforementioned third parties in accordance with The Applicable federal and state regulations.

Users further agree to their information being used for advertising and marketing reasons relevant to their interest in the loan service.

The App maintains the right to give, sell, or otherwise disclose this info to the aforementioned parties for the stated purposes.

PII voluntarily disclosed by the user via the loan request form and any information provided directly to a lender is not accessible by The App or its operators because of encryption.

All data entered in this context is sent securely to the network of Lender Partners, who may then access it as part of the lending assessment process.

Submitting the form constitutes consent to communications from the Partner Lender regarding the loan request and any relevant administration of a loan product.

Users who submit a request waive their right to file any claim related to Partner Lender communications to the FTC or any other agency.

Sharing Personally Identifiable Information

Sharing PII is necessary by The App to aid the loan request process and so third-party Lender Partners have the necessary information to issue loans.

The App might also share PII with Lender Partners for the purpose of developing a superior user experience and improving the service as a whole.

If necessary, The App may share PII with affiliates or signees if deemed necessary to fulfill this aim.

When connected to third parties, they have their own privacy policies describing how they use and/or share users’ personal information.

On other occasions The App may share PII to entities outside of the usual parties, is when responding to a legal demand, such as a court order or subpoena.

This includes assisting law enforcement or governmental agencies to maintain or exercise their legal rights; to defend against any legal claims, or if compelled in law to do so.

Where wrongdoing, including but not limited to fraud or other illegal activity is suspected, PII may also be used in the course of an investigation, or to prevent or defend against such wrongdoing; or to protect or defend the rights, property, or safety of The App’s parent company, its employees, other app or web users, or any others linked to the operations of The App; or to enforce its Terms and Conditions, other policies, or any other agreements.

Opt-Out

Users of The App have the right to opt-out of further correspondence from third parties or use of their PII after submitting a loan request form.

However, the user agrees that any initial use of The App is considered an automatic opt-in.

Links to Other Websites

After a loan request has been submitted, The App might link or automatically redirect the user to a third-party lender site that operates its own separate privacy policy and terms.

This App has no involvement in or responsibility for these sites and it is the user’s responsibility to read and understand any third-party privacy policies or terms of use.

A user can opt out of this process by closing The App before submitting a form.

Changes

Periodically, The App operator may change, revise, or otherwise update The App.

This could include adding technical features, new content, information, policies, or disclosures.

The right is reserved to do this without giving prior warning to any user and is at The App’s sole and absolute discretion.

Children’s Privacy

The App does not permit or knowingly gather the PII of children or persons under the age of 18.

Anybody under the age of 18 is not permitted to use The App and is below the age of legally obtaining loans and credit in many jurisdictions.

Security

The App uses secure encryption technology known as SSL among other security procedures to protect user-submitted information from being accessed and/or disclosed to third parties that aren’t authorized.

When data is submitted via the loan request form, it is securely shared with Partner Lenders over the internet. Once this data is received, The App is no longer responsible for its security.
